The 30-day registration deadline has no flexibility

Landlords and agents must protect deposits and serve prescribed information within 30 days of receipt. Miss that window and the penalty is automatic - up to three times the deposit amount. Process reliability matters more than price at this stage.

TDS gives you two routes to compliant deposit protection

TDS Custodial is free for everyone - TDS holds the deposit and funds operations through interest. TDS Insured lets agents and landlords hold the deposit themselves while paying a subscription-based fee. Both include free adjudication.

TDS Custodial (free)

Transfer the full deposit to TDS when the tenancy starts. TDS holds it securely for the duration. At end of tenancy, you raise a repayment request on the TDS portal. If disputed, TDS adjudicates and distributes. No charge to landlords or agents.

TDS Insured (subscription)

You or the landlord holds the deposit throughout the tenancy. Pay an annual subscription to TDS to insure it. On dispute, transfer the contested amount to TDS for adjudication. NRLA members receive discounted rates.

TDS Academy training

TDS Academy offers online and live training on deposit legislation, evidence presentation and adjudication outcomes. CPD-accredited. The adjudication workshop is one of the most-used free resources in UK lettings - and it materially improves dispute outcomes for agents who complete it.

Free dispute resolution

All TDS deposits come with access to the free alternative dispute resolution service. Adjudicators review evidence within approximately 30 working days. The decision is binding and significantly faster and cheaper than court proceedings.

Frequently asked questions

What makes TDS different from the other two government-approved schemes?
TDS is the only UK-owned, not-for-profit scheme of the three. It was also the first to establish a structured training programme (the TDS Academy) and produces the most comprehensive public data on adjudication trends in the private rented sector. Its Insured scheme uses a subscription model, which suits higher-volume landlords and agents better than the per-deposit fee model used by others.
Is TDS Custodial really free?
Yes. TDS Custodial is entirely free for landlords and agents. You register the tenancy, transfer the deposit by bank transfer, and TDS holds it for the duration. TDS funds custodial operations through interest earned on deposits held. There are no registration fees, annual charges, or per-deposit fees.
When should an agent choose Insured over Custodial?
Insured suits agents and landlords who want to retain the deposit funds during the tenancy and who have sufficient volume to make an annual subscription cost-effective. For most single-property landlords or lower-volume agents, Custodial is simpler and cheaper. For larger portfolio landlords or agencies, the Insured subscription model can be more predictable than per-deposit fees.
How does the TDS dispute resolution process work?
When a dispute is raised, both parties submit written evidence to TDS. Adjudicators review check-in and check-out reports, photographs, invoices and correspondence. A binding decision is typically reached within 30 working days of all evidence being received. The standard of proof is balance of probabilities - the question is whether it is more likely than not that the claimed loss is attributable to the tenant.
What is the TDS Academy and who should use it?
TDS Academy is a programme of online and live training covering deposit legislation, evidence presentation and real adjudication case studies. It is CPD-accredited and free to access. Agents who complete the adjudication workshop consistently present better-evidenced claims and achieve better outcomes when disputes do arise. It is one of the most practical free resources available in UK lettings.
Does TDS operate in Scotland and Northern Ireland?
TDS operates directly in England and Wales. In Scotland, the equivalent is SafeDeposits Scotland. In Northern Ireland, TDS Northern Ireland operates as a separate scheme. If your agency operates across multiple jurisdictions, TDS can advise on the appropriate scheme for each region.
What happens to deposits under the Renters' Rights Act changes?

This reduces the risk of incomplete or incorrectly served prescribed information, which is one of the most common compliance failures in deposit protection. You still need to serve the prescribed information to the tenant within 30 days - TDS gives you the document, you handle the service.
